Welcome to Xmzive.

These Terms of Service (“Terms”) govern your access to and use of https://www.xmzive.com/ (the “Site”), including your purchase of products and use of services provided by Xmzive.

By visiting the Site, creating an account, submitting an order, or otherwise using our services, you agree to these Terms and the policies referenced below. If you do not agree, please do not use the Site or submit an order.

1. About Xmzive

Xmzive is an independently owned U.S. online dress retail store based in Danville, Virginia. We offer women’s dresses and other products expressly displayed on our Site.

Xmzive is not an online marketplace. Unless an affiliation is expressly disclosed on a product page, we do not claim to represent or be officially affiliated with any third-party designer, manufacturer, retailer, or brand.

If a product page contains product-specific conditions that conflict with a general statement on another page, the clearly disclosed product-specific information will apply to that product, subject to applicable law.

3. Eligibility

To place an order, you must be at least the age of legal majority in your place of residence or have the permission and supervision of a parent or legal guardian who agrees to these Terms.

You may not use the Site or purchase products for any unlawful, fraudulent, or unauthorized purpose.

4. Permitted Website Use

You agree to:

• Use the Site only for lawful personal or household shopping purposes
• Provide accurate and complete information
• Comply with these Terms and applicable laws
• Respect the intellectual property and privacy rights of others

You must not:

• Use the Site for fraudulent or unlawful activities
• Submit false, misleading, or unauthorized information
• Attempt to gain unauthorized access to the Site, customer accounts, or connected systems
• Introduce viruses, malicious code, or other harmful technology
• Interfere with Site security, checkout, inventory, or normal operation
• Use automated tools to scrape, copy, overload, or misuse the Site without permission
• Use another person’s identity or payment method without authorization
• Copy or commercially exploit Site content without permission

5. Customer Accounts

If account registration is available, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to provide accurate account information and update it when necessary. Please notify us promptly if you believe your account has been accessed without authorization.

We may suspend or restrict an account when reasonably necessary to investigate suspected fraud, security threats, misuse, or violations of these Terms.

6. Product Information

We make reasonable efforts to present product descriptions, images, colors, materials, sizes, prices, and availability accurately.

However:

• Colors may appear differently because of device displays and lighting conditions.
• Measurements may vary slightly because of measuring methods and normal production variations.
• Product packaging may change without materially changing the product.
• Availability may change before an order is accepted.

Product images are provided for reference. Customers should review the complete product description, available options, care information, and applicable size details before ordering.

7. Sizing and Fit

Our general Size Guide is provided as a reference. If a product page includes its own size chart or fit instructions, the product-specific information takes precedence.

Fit may vary depending on body shape, product design, fabric, construction, and personal preference. Customers are responsible for reviewing the available measurements and selecting a size.

A return based on size, fit, color, style, or personal preference is treated as a customer-preference return unless the item received differs materially from the size or product ordered.

8. Prices, Currency, Taxes, and Shipping Charges

Prices are displayed in United States Dollars (USD) unless another currency is expressly shown during checkout.

The final checkout total may include:

• Product prices
• Applicable discounts
• Applicable taxes
• Any shipping charge disclosed before payment

Eligible orders shipped within the United States receive Free Standard Shipping unless a different service and charge are clearly displayed before payment.

We may change prices or promotions at any time. A change will not alter the price of an order that has already been accepted, except when correction is required because of an obvious pricing or technical error and permitted by law.

9. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products under these Terms. An automated Order Confirmation acknowledges that we received the order but does not necessarily constitute final acceptance.

We may review, accept, refuse, limit, or cancel an order for legitimate reasons, including:

• Product unavailability
• An obvious pricing or product-information error
• Failed or declined payment
• Suspected fraud or unauthorized activity
• Incorrect or incomplete customer information
• Shipping restrictions
• Unusually large quantities or suspected unauthorized resale

An order is accepted when we send a Shipping Confirmation or otherwise expressly confirm acceptance.

If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

10. Customer Information Accuracy

Customers are responsible for providing accurate and complete:

• Name and contact information
• Billing information
• Shipping address, including apartment or unit number
• Postal code and state
• Product, size, color, and quantity selections

Please review all information before submitting an order. Contact Customer Support promptly if a correction is needed.

We will make reasonable efforts to assist before fulfillment begins, but changes cannot be guaranteed after an order has been processed or shipped.

11. Payments

Payments are processed through Shopify and supported third-party payment providers.

Available payment methods may include:

• Credit and Debit Cards: Visa, Mastercard, American Express, Diners Club, and Discover
• Digital Wallets: Apple Pay, Google Pay, and Shop Pay
• Alternative Payment Method: PayPal

The payment options available for a specific transaction will be displayed during checkout.

By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize the applicable payment provider to process the checkout total.

Xmzive does not store complete payment card numbers on its own website servers. Additional payment terms are provided in our Payment Policy.

12. Fraud Prevention and Order Verification

We may use Shopify, payment providers, and fraud-prevention services to review transactions and protect customers and our store.

We may place an order on hold, request reasonable verification, or cancel an order when payment or order information cannot be verified.

Xmzive will not ask customers by email, telephone, text message, or social media to provide a complete card number, card security code, account password, or one-time verification code.

13. Order Processing, Shipping, and Delivery

Our standard timelines for eligible U.S. orders are:

• Order Processing Time: 1–3 business days
• Standard Shipping Time: 6–9 business days after shipment
• Estimated Total Delivery Time: 7–12 business days
• U.S. Standard Shipping Cost: Free ($0)

Processing and delivery times are estimates based on normal operating conditions. Carrier delays, weather, public holidays, address problems, and other circumstances may affect delivery.

If we cannot ship within the stated or otherwise agreed timeframe, we will provide notice and the options required by applicable law, which may include agreeing to a revised shipping date or canceling the unshipped order for a refund.

Shipping destinations, tracking, delays, lost packages, and address requirements are governed by our Shipping Policy.

14. Returns and Refunds

Eligible products may be returned within 30 calendar days after delivery under our Return and Refund Policy.

Key terms include:

• Return Method: By mail
• Restocking Fee: None ($0)
• Customer-Preference Returns: Customer pays return shipping
• Incorrect, Damaged, or Confirmed Defective Items: Xmzive pays return shipping
• Approved Refund Method: Original payment method
• Refund Processing: 1–3 business days after return approval

Dresses and other eligible clothing must be unworn, unwashed, unaltered, and returned with applicable original tags and packaging.

A reasonable indoor fitting is permitted. Products showing stains, makeup, deodorant marks, odors, alteration, or extended wear may not qualify for return.

Please contact Customer Support before mailing a return so we can provide return instructions and identify the package. Contacting us does not shorten or replace the 30-day return period.

15. Exchanges

Exchange requests are subject to product availability, the return period, product condition requirements, and completion of the return process.

If the requested replacement is unavailable, an eligible customer may receive a refund to the original payment method and place a new order for another available product.

16. Order Cancellations

Customers may request cancellation before an order has shipped. Please contact us as soon as possible after ordering.

We will make reasonable efforts to accommodate the request, but cancellation cannot be guaranteed after processing or fulfillment has started.

If an order has already shipped, the customer may request an eligible return after delivery under our Return and Refund Policy.

17. Electronic Communications

By providing an email address or telephone number, you agree that we may send transactional communications relating to:

• Orders and payments
• Shipping and delivery
• Returns and refunds
• Account or security issues
• Customer Support requests
• Changes materially affecting our services or policies

Transactional communications are separate from marketing communications. Marketing messages may be unsubscribed from using the method provided in the message.

18. Intellectual Property

Site content—including text, graphics, logos, product descriptions, photographs, videos, page layouts, and design elements—is owned by, licensed to, or otherwise used with authorization by Xmzive and is protected by applicable intellectual property laws.

You may access and use Site content for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, republish, sell, or commercially exploit Site content without prior written permission from the applicable rights holder.

Third-party names, logos, and trademarks remain the property of their respective owners.

19. Reviews, Comments, and Customer Content

If you submit a review, photograph, comment, suggestion, or other content, you represent that:

• The content is truthful and based on your genuine experience.
• You have the right to submit the content.
• The content does not infringe another person’s rights.
• The content is not fraudulent, unlawful, threatening, or malicious.
• The content does not contain harmful code or sensitive personal information.

You retain ownership of content you create. By submitting content for publication, you grant Xmzive a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format, and distribute it for store operation, Customer Support, and marketing, subject to applicable law.

We may moderate or remove content that violates these Terms, but we are not obligated to publish every submission.

20. Third-Party Services and Links

The Site may use or link to third-party services, including Shopify, payment providers, shipping carriers, analytics providers, and social media platforms.

Third-party services operate under their own terms and privacy policies. Xmzive is not responsible for an external website’s independent content, availability, security, or privacy practices.

A link does not necessarily mean that Xmzive endorses the third party or its content.

21. Privacy

Our collection and handling of personal information are described in our Privacy Policy.

By using the Site, you acknowledge that you have had an opportunity to review the Privacy Policy and available privacy controls.

22. Errors, Inaccuracies, and Corrections

The Site may occasionally contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions, availability, or delivery information.

We may correct an error, update information, or cancel an affected order when reasonably necessary and permitted by law.

If a material error affects an order after payment, we will contact the customer when reasonably possible and provide an appropriate option, which may include confirming the corrected information or canceling the affected order for a refund.

23. Site Availability

We may update, suspend, or modify Site functionality for maintenance, security, technical, operational, or legal reasons.

We do not guarantee that the Site will always be uninterrupted or error-free. However, this does not affect rights relating to an accepted order or rights that cannot be excluded under applicable law.

24. Disclaimer of Warranties

To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not make warranties concerning continuous Site availability or the absence of every technical error.

Products remain subject to the descriptions and express representations displayed on the applicable product page.

Nothing in these Terms excludes:

• Express promises made in a product description or store policy
• Warranties that cannot legally be excluded
• Statutory consumer-protection rights

25. Limitation of Liability

To the fullest extent permitted by applicable law, Xmzive will not be liable for indirect, incidental, special, or consequential losses arising solely from use of or inability to access the Site.

Nothing in these Terms limits or excludes liability for:

• Fraud or fraudulent misrepresentation
• Intentional misconduct or gross negligence where liability cannot be excluded
• Death or personal injury where caused by legally actionable conduct
• Violation of rights that cannot be waived under applicable law
• Any other liability that applicable law does not permit us to exclude

26. Events Outside Reasonable Control

Xmzive will not be responsible for a delay or failure caused by circumstances outside our reasonable control, such as severe weather, natural disasters, transportation disruptions, labor disputes, public emergencies, government actions, carrier interruptions, or widespread technology failures.

This section does not eliminate obligations to provide legally required notices, cancellation options, or refunds for unshipped orders.

27. Suspension or Termination

We may suspend or terminate access to the Site when a user materially violates these Terms, engages in fraud or abuse, threatens Site security, or uses the Site unlawfully.

Termination does not affect rights and obligations arising from an accepted order or provisions that reasonably survive termination.

28. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal laws of the United States, without regard to conflict-of-law principles.

Mandatory consumer protections available under the laws of a customer’s place of residence remain unaffected where they cannot legally be waived.

If a dispute arises, either party may contact the other to seek an informal resolution. Contacting Xmzive first is encouraged but is not a condition that limits a customer’s right to contact a payment provider, regulator, consumer-protection agency, or court.

Any legal proceeding may be brought before a court with lawful jurisdiction. These Terms do not require mandatory arbitration and do not contain a class-action waiver.

29. Severability, Waiver, and Assignment

If a provision of these Terms is determined to be unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

A failure to enforce a provision does not waive the right to enforce it later.

You may not transfer your rights or obligations under these Terms without our consent. Xmzive may transfer its rights and obligations as part of a legitimate business transfer, subject to applicable law and without reducing existing consumer rights.

30. Entire Agreement

These Terms, together with the policies incorporated by reference and any product-specific terms disclosed before purchase, constitute the agreement between the customer and Xmzive concerning use of the Site and the applicable purchase.

31. Changes to These Terms

We may update these Terms to reflect changes in our services, business practices, technology, or legal requirements.

The revised Terms will be posted on this page with an updated “Last Updated” date. Changes apply prospectively unless applicable law permits or requires otherwise.

An order will generally remain subject to the version of the applicable purchase terms presented when the order was submitted.
